Authorizing the NSCB Technical Staff to Enter into a Memorandum of Agreement with the Private Sector on Data Subscription Services

AUTHORIZING THE NSCB TECHNICAL STAFF TO ENTER
INTO A MEMORANDUM OF AGREEMENT WITH THE PRIVATE SECTOR
ON DATA SUBSCRIPTION SERVICES

WHEREAS, National Statistical Coordination Board (NSCB) Resolution No. 10, s. 1997, “Adoption and Implementation of the Government Statistics Accessibility Program (G-SAP),” provides for a “conducive environment for a shared marketing of statistical information and services towards an optimum use of resources for the benefit of the users by developing strategic alliance among data producers and distributors in the government and private sector”;

WHEREAS, NSCB Resolution No. 8, s. 1999, “Adoption of the General Standards on Statistical Information Dissemination,” states that to improve timeliness and accessibility of government information, information should be disseminated through agency websites, libraries, NSICs, bookshops, electronic or ordinary kiosks, airports or other public places or through information brokers or distributors;

WHEREAS, Section 11 of the General Provisions of the General Appropriations Act 2005, authorizes departments, bureaus, offices or agencies to sell their official publications and the proceeds derived from such sale may be made available to defray the printing cost of these publications; provided that the agency concerned shall submit to the DBM a report of the proceeds from the sale and the expenses incurred and the excess shall be remitted to the National Treasury and accrue to the General Fund;

WHEREAS, NSCB Resolution No. 11, s. 1999, “General Pricing Policy of the Philippine Statistical System (PSS),” specifies that transactions with information brokers shall be done thru a Contract with the Agency/Unit, ensuring proper acknowledgment of data sources;

WHEREAS, Executive Order No. 159, s. 1994, directs all departments, bureaus, offices, units and agencies, including government-owned or controlled corporations to revise their fees and charges at just and reasonable rates sufficient to recover at least the full cost of services rendered;

WHEREAS, the NSCB provides paid subscription services for its statistical information products as a mechanism for wider dissemination among data users as well as to generate income under the cost recovery principle;

WHEREAS, the NEDA Legal Staff opines that a Board resolution authorizing the Secretary General of the NSCB to enter into a Memorandum of Agreement concerning data subscription services is necessary;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED that the Board authorize the NSCB Technical Staff to enter into a Memorandum of Agreement with the private sector specifically, but not limited to, information brokers, resellers, and/or distributors on data subscription services, towards enhanced dissemination and utilization of PSS products and services;

BE IT RESOLVED FURTHER that the NSCB Secretary General be authorized to sign for and on behalf of the NSCB Technical Staff.
